How Alimony (Spousal Support) Works in Utah

Alimony isn’t automatic, and there is no simple calculator or official formula for it in Utah. Instead, a judge looks at the big financial picture of your marriage to decide three basic things: Should alimony be paid? How much? And for how long?

The Three Big Questions the Court Asks

When deciding alimony, judges focus on three main facts:

  • What does the lower-earning spouse actually need? The court looks at what it takes for them to maintain a lifestyle that is reasonably close to what they had during the marriage.
  • Can the higher-earning spouse afford to pay? The court looks at what the higher earner has left over after paying for their own basic, reasonable monthly living costs.
  • What was the couple’s standard of living? Were they living frugally, or did they have a high-cost lifestyle?

The General Rule: If there isn’t enough money to go around for both people to keep their original lifestyle, Utah courts try to share the burden equally. That means both people usually have to scale back their spending.

Other Important Rules for Alimony

As a general rule in Utah, you usually won’t have to pay (or receive) alimony for longer than the marriage actually lasted. If you were married for 7 years, alimony will generally cap out at 7 years max.

If one spouse stayed home for years to raise kids or manage the house, the court recognizes that their earning power took a hit and factors that into the decision.

Utah is one of the states where bad behavior—like cheating, physical abuse, or hiding money—can be considered by the judge when deciding whether to award alimony or how much to give.
